According to Doctor Who Confidential, Robert Shearman had to write a second version of the script because it was not initially known if the new series could obtain the rights to use the Daleks from Terry Nation's estate, so he had to create an alternate alien race that would have been used had the Daleks not been available.

At first the estate of Terry Nation refused permission for them to use Daleks in the show (Terry Nation held copyright over the Daleks). One of the reasons they refused permission was because of the BBC granting permission for the Daleks to be used in Looney Tunes: Back in Action. A huge fan of Doctor Who, Steve Martin, who was the one who insisted Daleks be used in the movie, heard about the news and wrote a letter of apology to the Terry Nation estate and upon receiving it, the Terry Nation estate granted permission.

Had the Daleks been unavailable, Russell T. Davies had made a sketch of a potential replacement robotic creature called "future human". The design of this creature was later adapted as the Toclafane in TV: The Sound of Drums.

Though it has not been confirmed, this is likely the first episode of the revived series in which the events were possibly changed by later stories, as in this episode no one seemed to know what a Dalek was, despite the previous huge invasions from 2007 to 2009.

The year the Dalek landed on Earth, 1962, was the year prior to 1963, the debut of Doctor Who (and by extension, the Dalek race itself).

This is the first televised Dalek story not to feature their creator Davros or use the ... of the Daleks naming scheme sinceDeath to the Daleks in 1974.
